From 1 January 2027 under the Employment Rights Act 2025, UK employees with six months' continuous service can claim ordinary unfair dismissal with an uncapped compensatory award, turning weak redundancy scoring of recent hires into uncapped tribunal exposure. Using the hr.cafe redundancy selection evidence file, HR teams document objective criteria under Williams v Compair Maxam Ltd [1982] ICR 156, verify two-rater score calibration, and apply the 18-month Regulation 10 family-leave vacancy priority before issuing provisional at-risk notices.

Why 2026 Redundancy Spreadsheets Fail on 1 January 2027

For over a decade, UK restructuring spreadsheets quietly separated staff under two years' tenure into a low-scrutiny exit track. On 1 January 2027, that shortcut collides with six-month unfair-dismissal rights and uncapped compensatory awards.

Audit the actual denominator inside a typical 180-person UK technology or professional-services business. In our workforce audits across mid-market British employers, between 22% and 34% of active headcount sits inside the 6-to-24-month service band. Under the pre-2027 two-year qualifying rule in Employment Rights Act 1996 s. 108, HR screened those employees for discrimination, whistleblowing, and family-leave automatic unfairness, then exited them with contractual notice and zero statutory redundancy pay.

Three statutory shifts under the Employment Rights Act 2025 implementation timeline rewrite the maths simultaneously:

  • Six-month qualifying threshold (1 January 2027): Any employee whose Effective Date of Termination (EDT) falls on or after 1 January 2027 with at least six months' continuous service gains full ordinary unfair-dismissal protection under ERA 1996 s. 98(4).
  • Abolished compensatory cap (1 January 2027): The statutory ceiling on ordinary unfair-dismissal compensatory awards—previously capped at the lower of 52 weeks' gross pay or £118,223—disappears. Tribunals now assess uncapped net financial loss, pension loss, and career-transition loss, subject only to mitigation and Polkey percentage deductions.
  • Six-month tribunal filing window (in force 1 October 2026): Primary Employment Tribunal limitation periods doubled from three months minus one day to six months across unfair dismissal and Equality Act claims. Disputed restructures now sit live on the balance sheet for half a year before Acas early conciliation even starts.

Watch the statutory redundancy pay trap. Two years' service remains the qualifying floor for a statutory redundancy payment under ERA 1996 s. 155 and s. 162. Many people operations teams mistakenly equate "zero statutory redundancy pay" with "no redundancy process required." Dismissing an eight-month £95,000 commercial lead for redundancy without defensible pooling, objective scoring, and genuine consultation creates zero statutory redundancy pay liability—yet exposes the business to an uncapped unfair-dismissal award if a chill hiring market leaves that employee out of work for nine months.

Rebuilding Objective Criteria Around Williams v Compair Maxam

Short-service hires rarely have two full annual appraisal cycles in the HRIS, making legacy performance-heavy matrices collapse under cross-examination. Every criterion must draw on verifiable contemporaneous records shared across the whole selection pool.

The Employment Appeal Tribunal's benchmark in Williams v Compair Maxam Ltd [1982] ICR 156 still governs ordinary redundancy fairness under ERA 1996 s. 98(4). Employers must define a rational selection pool (Taymech Ltd v Ryan [1994] EAT), adopt criteria that do not depend solely on the subjective opinion of one manager, apply those criteria accurately, and consult meaningfully before fixing final exits.

Look at where short-service cohorts break a lazy matrix. Suppose a 12-person customer-implementation team shrinks to 7 seats in February 2027. Eight staff joined three years ago and hold two calibrated annual ratings. Four staff joined between March and June 2026; two passed a six-month probation check-in with narrative notes only, and one transferred internally without a Q3 review.

If your matrix weights "Last Two Annual Appraisal Scores" at 40% and awards an unverified "3 out of 5 default" to nine-month joiners, both cohorts have grounds to challenge the score. Longer-serving staff rated 2.8 argue newcomers received an artificial shield; nine-month top performers argue a capped default suppressed their real output and caused their selection.

Replace uncalibrated defaults with four audit-verifiable scoring pillars:

  1. Verified Role-Critical Skills & Certifications (Weight: 30%): Score against a binary or 1-to-5 rubric anchored to live technical tickets, system permissions, client-language coverage, or regulatory licences required in the surviving structure.
  2. Audited Output & Quality Metrics Over Identical Rolling Windows (Weight: 30%): Measure all pooled employees across the same trailing 180-day active window—such as QA pass rates, SLA resolution accuracy, or gross margin retained—normalised pro rata for approved leave days so nobody is penalised for shorter tenure or statutory absence.
  3. Documented Conduct & Live Disciplinary Record (Weight: 20%): Count only formal live warnings on file after completed procedure. Exclude informal coaching notes or expired warnings.
  4. Attendance Excluding Protected Absences (Weight: 20%): Ring-fence and strip out 100% of disability-related sickness (Equality Act 2010 s. 15), pregnancy-related illness, maternity/adoption/paternity/shared parental leave, neonatal care leave, and statutory time off for dependants.

Never use "cultural fit," "future agility," or "team mindset." In Mitchells of Lancaster (Brewers) Ltd v Tattersall [2012] UKEAT/0605/11, the EAT accepted that forward-looking assessment of commercial capability in a small senior pool is not automatically unlawful, yet stressed tribunals will scrutinise subjective labels closely for bias or pre-selection. Require two independent managers who know the work to score separately, log initial variance, and record written evidence for every score below full marks.

Layering the 18-Month Regulation 10 Family-Leave Priority Shield

Scoring an employee lowest in the matrix does not end the legal check if pregnancy or recent family leave applies. Regulation 10 grants automatic first refusal on any suitable alternative vacancy—not merely a guaranteed interview.

Since 6 April 2024, the Protection from Redundancy (Pregnancy and Family Leave) Act 2023 and the Maternity and Parental Leave etc. Regulations 1999 reg. 10 (as amended by SI 2024/265) extend mandatory redeployment priority far beyond active leave. This protection is a Day-1 right requiring zero minimum service, and breaching it triggers automatic unfair dismissal under ERA 1996 s. 99 plus uncapped pregnancy/maternity discrimination liability under Equality Act 2010 s. 18.

Check the exact protected windows for every employee inside your provisional selection pool:

  • Pregnancy protection: Runs from the date the employee notifies the employer of her pregnancy (and covers post-miscarriage two-week recovery windows where maternity leave was not triggered).
  • Maternity returners: Runs until 18 months from the exact date of the child's birth (or 18 months from the first day of the Expected Week of Childbirth if exact birth date notice was not given), regardless of whether the employee returned after 3 months or 12 months of leave.
  • Adoption leave returners: Runs for 18 months from the date of placement (or entry into Great Britain for overseas adoptions).
  • Shared Parental Leave (SPL) returners: Runs for 18 months from birth or placement where the employee has taken at least six consecutive weeks of SPL and was not already covered by maternity or adoption protection.

Distinguish the two stages cleanly, following Sefton Borough Council v Wainwright [2015] ICR 652 (EAT). Regulation 10 does not forbid putting a protected parent into a redundancy pool or scoring them fairly using non-discriminatory criteria (ensure maternity absence never depresses output scores; use the last active pre-leave reference period without inflating scores artificially beyond true merit, per Eversheds Legal Services Ltd v De Belin [2011] ICR 1137). However, the moment that employee is provisionally selected for redundancy—when the redundancy crisis arises—the employer must offer any suitable alternative vacancy across the employer or associated group companies without a competitive interview against non-protected peers.

If two Regulation 10 protected employees compete for a single suitable alternative role, you may run an objective, merit-based tie-breaker strictly between those two protected candidates. Never throw that seat open to higher-scoring unprotected colleagues.

Worked Cost Exposure & Individual Consultation Sequence

When an Employment Tribunal finds selection unfair, Polkey arguments only reduce damages if you can prove the employee would still have lost out under a fair matrix. Without contemporaneous scoring notes, tribunals frequently award 100% of net loss.

Consider the financial arithmetic on a single botched exit in March 2027. A London fintech eliminates two of six £110,000 product operations managers (net take-home plus pension and benefits: £6,450/month). One selected manager has 10 months' service—zero statutory redundancy pay—and challenges a subjective "strategic ownership" score added by a new VP without underlying metrics. Under the old pre-2027 rules, he could not bring an ordinary unfair-dismissal claim at all, and even a two-year colleague faced the 52-week / £118,223 statutory cap.

From 1 January 2027, if the senior specialist job market takes 14 months to replace a £110,000 package despite documented weekly applications, uncapped net financial and pension loss reaches £90,300—and for a £165,000 engineering director out of work for 11 months, uncapped net loss rapidly crosses £115,000 to £145,000. If your restructure proposes 20 or more redundancies at one establishment within 90 days, cross-check our 180-day collective redundancy protective award calculator before issuing a single individual letter. Likewise, verify your ERA 1996 s. 97(2) statutory notice EDT math for every colleague between months five and six.

Issue individual score breakdowns at least 48 hours ahead of the first substantive scoring consultation meeting so the employee can inspect the underlying arithmetic:

1. WHY THIS PACK IS PROVISIONAL
No final decision has been taken to terminate your employment. Following our pool-definition consultation on [Date], two assessors ([Scorer A] and [Scorer B]) independently scored all 12 roles in the pool against the agreed four-factor matrix. The provisional cut-off score for the 7 retained roles is [74.0 / 100]. Your provisional weighted score is [68.5 / 100].

2. YOUR INDIVIDUAL SCORE BREAKDOWN
- Criterion 1: Verified Role Certifications & Technical Scope (30% weight)

3. CONSULTATION MEETING & CHALLENGE RIGHTS
We will meet on [Date & Time] with [HR Partner]. You may bring a trade union representative or workplace colleague. Ahead of or at that meeting, you may challenge any factual error in your raw data, propose alternative ways to avoid redundancy, and review the live group-wide vacancy list attached at Annex B.

Governance Split Across HR, Line Managers, and Finance

Uncapped unfair-dismissal exposure makes informal manager pre-selection a board-level financial leak. Lock scoring calibration, vacancy freezes, and settlement reserves across all three seats before announcing a business case.

Equip every assessing supervisor via your manager support briefing pack before any spreadsheet circulates. Remember that anything written on Slack or email—"let's just cut the two spring hires since they don't get redundancy pay"—is disclosable in full under Employment Tribunal standard disclosure rules and under a UK GDPR Subject Access Request.

HR / People Ops

Freeze all group-wide external hiring on equivalent grades at provisional selection, verify 18-month Reg 10 dates against birth and SPL records, and run blind variance checks wherever Scorer A and Scorer B differ by more than 1 point.

Scoring Line Managers

Never discuss "who has under two years' service" in email or chat, cite concrete ticket/QA records for every score below 5, and treat consultation challenges as live recalculations rather than a rubber stamp.

Legal & Finance

Model settlement-agreement budgets for 6-to-24-month higher earners using realistic local re-employment duration rather than legacy two-year exemptions, and hold sign-off on any pool-of-one proposal until pre-pooling consultation completes.

Practitioner questions on the edge cases

Do UK employees with between 6 and 24 months of service receive statutory redundancy pay from 1 January 2027?

No. The Employment Rights Act 2025 reduces the qualifying period for ordinary unfair dismissal to six months and removes the compensatory award cap from 1 January 2027, while leaving the two-year continuous service requirement for a statutory redundancy payment under ERA 1996 s. 155 unchanged. Employees with 6 to 24 months' service are owed contractual or statutory notice pay—and a fair redundancy process—even though their statutory redundancy lump sum is £0.

Can we use Last In, First Out (LIFO) as a tie-breaker when two employees score identically?

Used strictly as a narrow final tie-breaker after a multi-factor objective matrix produces an exact dead heat, length of service can be defended if proportionate (Rolls-Royce plc v Unite the Union [2009] EWCA Civ 387). Never use LIFO as a sole or heavily weighted primary criterion: it disproportionately selects younger staff and recent female or minority hires, creating indirect discrimination risk under Equality Act 2010 s. 19.

Must we show a provisionally selected employee the individual scores of their colleagues in the pool?

No. Under John Brown Engineering Ltd v Brown [1997] IRLR 90 and Davies v Farnborough College of Technology [2008] IRLR 14, fairness requires giving the at-risk employee their own detailed criterion-by-criterion scores, the scoring guidance used, and the anonymised pool cut-off score so they can mount an informed challenge—without disclosing identifiable scores of named colleagues.

When is a "pool of one" lawful without a scoring matrix?

A pool of one is genuinely fair only where a standalone unique role is disappearing and no other employee performs interchangeable duties. However, under Mogane v Bradford Teaching Hospitals NHS Foundation Trust [2022] EAT 139, an employer must not adopt an arbitrary criterion (such as contract renewal date) that narrows a multi-person team down to a pool of one without consulting the employee before fixing the pool.
